Small Claims
A small claims action is started by completing a small claims summons and complaint. Information on filing this form and other small claims forms are available on the Wisconsin Court System’s website.
E-filing is available at wicourts.gov
When the action is filed, the Clerk of Courts office will schedule a “return date” and insert this court date on the summons and complaint. An affidavit of non-military service is also required to be completed at the time of filing. Appearance by both parties on the return data is mandatory.
Filing Fees
If the defendant resides in Clark County, the fee is $96.50 and the defendant will be served by First Class Mail. If the defendant resides out of county the fee is $94.50 and personal service to be arranged by you is required. You must provide an affidavit or certificate of service prior to your court date. If this is an eviction action the fee is $94.50 and personal service is required. Mail completed forms to:
